- View performance, usage, and related analytics
We may, in the future, offer additional services including:
- Remote control of your BESS (e.g. charge/discharge scheduling)
- Participation in energy trading or export to the grid
Any additional services will be subject to these Terms and any additional terms notified to you.
4. Eligibility
You must:
- Be at least 18 years old
- Have the legal authority to enter into this agreement
- Ensure that all information you provide is accurate and up to date
5. Account and Security
To use the Service, you may be required to create an account.
You agree to:
- Keep your login credentials secure
- Not share your account with others
- Notify us immediately of any unauthorised access
We are not responsible for losses resulting from unauthorised use of your account where you have failed to keep your credentials secure.
6. Subscription and Fees
Access to the Service may require a paid subscription.
- Fees will be clearly displayed before you subscribe
- Subscriptions renew automatically unless cancelled
- You may cancel at any time, but fees already paid are non-refundable unless required by law
We reserve the right to change pricing with reasonable notice.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to systems or data
- Interfere with or disrupt the Service
- Reverse engineer, copy, or exploit any part of the Service without permission
8. Data and Privacy
We process personal data in accordance with our Privacy Policy.
This includes:
- Information about you
- Data from your energy system
You are responsible for ensuring that you have the right to share any data connected to your BESS with us.
9. Energy System Monitoring, Control and Grid Participation
9.1 Nature of the Service
The Service may include:
- Monitoring of your battery energy storage system (“BESS”)
- Automated or manual control of charging and discharging Optimisation of energy usage and export
- Participation in electricity markets, grid services, or demand response schemes
We act as a technology service provider only and do not act as your energy supplier, broker, or financial advisor.
9.2 No Guarantee of Financial Performance
You acknowledge and agree that:
- Any forecasts, projections, or estimates (including revenue, savings, or arbitrage opportunities) are indicative only
- We do not guarantee any level of financial return, savings, or performance
- Market conditions (including pricing, demand, and regulation) may change at any time
You use the Service at your own risk in relation to financial outcomes.
9.3 User Responsibility for System and Permissions
You are solely responsible for:
- Ensuring you own or have the legal right to control the BESS
- Ensuring your system is properly installed, maintained, and compliant with applicable laws and standards
- Obtaining any required permissions from:Your energy supplierDistribution Network Operator (DNO)Aggregators or grid operators
- Ensuring participation in any grid or trading scheme is permitted under your agreements
We are not responsible for any breach of third-party agreements.
9.4 Automated Control and Operational Risk
Where you enable control features:
- The Service may automatically control your system based on algorithms, market signals, or your settings
- Instructions may be executed without real-time confirmation
- Delays, outages, or incorrect signals may occur
You acknowledge that:
- Control actions may affect battery lifespan, performance, and availability
- Charging/discharging may occur at times you did not anticipate
- Exporting energy may not always result in payment
You accept all operational risks associated with enabling control functionality.
9.5 Grid Participation and Regulatory Status
You acknowledge that:
- Participation in electricity markets or grid services may be subject to regulation by Ofgem or other authorities
- You are responsible for complying with all applicable laws, licences, and regulatory requirements
- We do not guarantee that the Service complies with all regulatory requirements applicable to your specific circumstances
Unless expressly stated otherwise in writing:
- We do not act as a licensed electricity supplier, trader, or aggregator
- We do not enter into market transactions on your behalf as principal
9.6 Third-Party Integration and Market Access
The Service may integrate with:
- Energy suppliers
- Grid operators
- Market platforms (including services similar to the Balancing Mechanism)
- Hardware and inverter providers
We are not responsible for:
- Failure of third-party systems
- Inaccurate pricing or settlement data
- Delays or failures in payments from third parties
Any contractual relationship with third parties is between you and them.
9.7 Data Accuracy and Dispatch Risk
You acknowledge that:
- Data used for optimisation may be delayed, incomplete, or inaccurate
- Dispatch instructions may not be executed as intended due to:Connectivity issuesHardware limitationsThird-party failures
We are not liable for:
- Missed trading opportunities
- Imbalance charges
- Settlement discrepancies
- Losses caused by incorrect or delayed data
9.8 Limitation of Liability for Energy Activities
To the fullest extent permitted by law:
- We are not liable for:Loss of revenue from energy tradingLoss of export payments or incentivesIncreased energy costsBattery degradation or reduced lifespan
- You assume full responsibility for decisions made using the Service
Nothing in this section excludes liability that cannot be excluded under the Consumer Rights Act 2015.
9.9 Right to Disable Control Features
We may suspend or disable control or trading features:
- To comply with legal or regulatory requirements
- Where we identify safety, security, or system risks
- Where third-party integrations are unavailable
We are not liable for any losses resulting from such suspension.
9.10 Future Services
Additional services (including aggregation, trading, or optimisation services) may be subject to separate terms, including:
- Revenue-sharing arrangements
- Agency or intermediary roles
- Additional risk disclosures
You will be notified and required to accept such terms before participating.
10. Third-Party Services
The Service may rely on third-party systems (e.g. hardware providers, energy suppliers, grid operators).
We are not responsible for:
- Failures or inaccuracies caused by third parties
- Changes to third-party services that affect our Service
11. Intellectual Property
All content in the Service, including software, data visualisations, and design, is owned by us or our licensors.
You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal or internal business use.
You must not:
- Copy, modify, or distribute any part of the Service
- Create derivative works without our permission
12. Suspension and Termination
We may suspend or terminate your access if:
- You breach these Terms
- We reasonably believe there is a security risk
- Required by law or regulation
Subject to terms of agreement, you may stop using the Service at any time.
13. Limitation of Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded under law
To the extent permitted by law:
- We are not liable for indirect or consequential losses
- We are not liable for loss of profit, revenue, or anticipated savings
- Our total liability shall not exceed the amount you paid to us in the 12 months before the claim
14. Service Availability
We do not guarantee that the Service will always be available or uninterrupted.
We may:
- Suspend or withdraw the Service
- Update or change functionality
We will try to provide reasonable notice where possible.
15. Changes to These Terms
We may update these Terms from time to time.
We will notify you of material changes. Continued use of the Service after changes take effect means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of Singapore.
You agree that the courts of Singapore will have exclusive jurisdiction.
